Ecuador Employment Guide
Labor law, hiring, contracts, benefits, and expat work permits for employers
Employment Contracts
All employment relationships must be documented in writing. The standard contract is indefinite-term (plazo indeterminado). Fixed-term contracts (plazo determinado) are permitted for specific projects or temporary needs but cannot exceed 2 years unless justified. Part-time contracts are recognized but must specify hours. All contracts must be registered with the Ministry of Labor.
Wages and Benefits
The 2026 minimum wage is approximately $470/month. The 13th salary (aguinaldo) is paid in December based on full-year service. The 14th salary is paid in March/April (amount varies by region, roughly $380-430). Overtime: 1.5x weekdays, 2x weekends/holidays. IESS contributions: employer 12.15%, employee 9.45%. Vacation: 15 days per year after one year of service.
Termination and Severance
Indefinite-term employees can only be dismissed for cause (misconduct, poor performance with documentation, or force majeure). Unjustified dismissal requires severance pay (desahucio) of one month's salary per year of service, capped at 25 months. Fixed-term employees dismissed before contract end are entitled to the remaining salary. Resignation requires 30 days' notice.
Expat Employment
Foreign workers need a work visa (contrato de trabajo) sponsored by the employer. The employer must demonstrate that the position cannot be filled by an Ecuadorian. Work visas are typically valid for 2 years and renewable. Highly skilled professionals, executives, and technical specialists have streamlined processing. Employers must register foreign workers with the Ministry of Labor and IESS.
Frequently Asked Questions
What is the minimum wage in Ecuador?
The unified minimum wage for 2026 is approximately $470 per month. This is set annually by the National Labor Council considering inflation and productivity. Some sectors (export agriculture under specific conditions) have different minimums.
How does the 13th and 14th salary work?
The 13th salary (aguinaldo) is equivalent to one month's salary, paid in December, prorated for service less than a full year. The 14th salary is a regional cost-of-living bonus paid in March/April, amounting to roughly $380-430 depending on the province. Both are mandatory.
Can I hire remote workers from abroad?
Yes, but foreign remote workers without Ecuadorian residency cannot be formally employed under Ecuadorian labor law. Many companies engage them as independent contractors or through foreign subsidiaries. If the worker resides in Ecuador, formal employment with IESS registration is required.
